Abstract

This article is devoted to a comprehensive analysis of the rights of origin in the copyright system in digital platforms. The methodological basis consists of a comprehensive dogmatic analysis of the norms of international treaties and a method of legal modeling of new regulatory protection mechanisms. The scientific novelty lies in the detailed theoretical substantiation of the concept of "authorized traceable identification of origin" based on distributed blockchain technologies. The authors state the systemic crisis of traditional protective mechanisms in the face of global digital challenges of our time. The key problems of law enforcement have been identified: the legal uncertainty of the status of digital platforms, a significant gap in the cost of content, and the low efficiency of notification and deletion procedures. Special attention is paid to the transformation of moral rights into metadata and modern technical means of legal protection. The introduction of a mandatory unique digital identifier for each work is proposed as a key solution. The implementation of these measures is aimed at creating a unified global registration system, ensuring full transparency of turnover and ensuring fair remuneration for all authors. The implementation of the proposed systemic changes in key international acts will effectively overcome the current legal uncertainty and lay a solid foundation for the sustainable development of intellectual property, balancing the private interests of creators and the commercial interests of intermediaries.
