Abstract

The contemporary stage of development of artificial intelligence (AI) technologies and their integration into the judicial systems of the Republic of Azerbaijan and the Republic of Kazakhstan has heightened the importance of a comparative legal analysis of the regulation of judicial digitalization. A comparative approach makes it possible to identify both common features and distinctive characteristics of legal regulation, as well as to determine promising directions for further development.

This article examines current trends in the implementation of artificial intelligence within the courts of the two Republics and analyzes the regulatory legal framework governing the application of AI technologies.

The study addresses problematic issues related to data protection and confidentiality in the process of AI deployment and highlights the specific features of determining the liable entity for the consequences of AI activities in the Republic of Kazakhstan.

The article substantiates the position that the application of artificial intelligence within the judicial systems of the Republics should contribute to enhancing judicial efficiency and strengthening the protection of the rights and legitimate interests of citizens. At the same time, in developing a model for the permissible use of AI in the judiciary, particular emphasis should be placed on the concept of the “limited use of AI,” according to which AI is employed in judicial activities for the purpose of optimizing court operations and improving the quality of justice, while the final decision in a case remains exclusively within the competence of the judge.

The research employed various methods, including comparative legal analysis, logical-analytical methods, synthesis, and others. The subject matter of the study comprises the legislation of Azerbaijan and Kazakhstan, subordinate нормативные legal acts, and legal doctrine.
