International standards of fair justice: a genre crisis or a new purpose?

Abstract

This article examines the transformation of the standards of fair justice set by the practice of the European Court of Human Rights in the legal system of the Russian Federation. The termination of Russia's membership in the Council of Europe and withdrawal from the European Convention on Human Rights, although they significantly lowered the status of both the Convention itself and the rulings of the European Court of Human Rights for Russian jurisprudence, however, their role as one of the development guidelines has not been lost to this day. The constitutionalization of international standards of fair justice is accompanied by their sovereignization – the crisis of modern liberal ideology, transmitted mainly through European legal norms and judicial practice, contributes to regionalization, including standards of fair justice. However, the creation of standards of justice, both in terms of requirements for national judicial systems and in terms of principles and norms applicable to the structure and functioning of international jurisdictional bodies themselves, is possible only if there is a full-fledged judicial body for the protection of human rights and freedoms. Of the regional integration associations, the Caribbean Community (CARICOM) and the Organization for the Harmonization of Business Law in Africa (OHADA) have such a structure.
