On the Concept of Energy Law and Its Place in the System of Domestic Law: Theoretical and Legal Aspects

This article is devoted to the study of one of the unresolved contemporary problems of the dynamically developing Russian energy law – the problem of defining its essence and place (significance) in the system of domestic law. To resolve this problem, the author of the article has studied and summarized the positions of legal scholars on this issue, which they have expressed in the educational and scientific legal literature published in recent years. Having discovered and noted the signs of subjectivism in the studied assessments of the state and role of modern energy law, the author proposes to use the formal-legal method as a basis and to determine the place of energy law in the system of Russian law based on the specific provisions of the current Russian energy legislation in their relationship with the norms of other sources of law. Based on the results of the study, the author concludes that energy law in Russia is currently an interdisciplinary legal institution, and provides arguments in support of this conclusion.
